Artificial intelligence applied in judicial processes.

The Second Collegiate Court for Civil Matters of the Second Circuit established the minimum requirements for the use of artificial intelligence in judicial proceedings by issuing reiterated case law rulings with digital records 2031639 and 2031640 (dated January 9, 2026). These minimum requirements are as follows:
- A) Proportionality and harmlessness.
- B) Personal data protection.
- C) Transparency and explainability.
- D) Human supervision and decision-making.
The above applies as long as the use is limited to auxiliary tasks (such as calculating amounts to set guarantees) without replacing the jurisdictional work of deliberation and decision-making.
To this end, it took as a reference various soft-law regulations such as UNESCO’s Recommendation on the Ethics of Artificial Intelligence and its ethical principles.
These jurisprudences are relevant because they establish the minimum elements for the use of artificial intelligence in judicial proceedings, a novel topic in the Mexican legal framework.
